“Despite the clear disclosure by UPS that the first $100 of declared value coverage is free or at no charge, UPS has systematically charged and caused its agent and sales network to charge customers an additional amount for coverage for the first $100 when they purchase additional declared value coverage,” the lawsuit contends.

The complaint alleges that UPS has charged customers for the first $100 of declared value coverage even though UPS already accepts liability for loss or damage for all packages up to $100 as part of its normal service fee.

It was the carriers who suffered the brunt of the criticism, but many of the tardy deliveries weren’t their fault, according to Jerry Hempstead, who spent decades as an executive with DHL and Airborne Express, and now heads up his own firm, Hempstead Consulting. He blamed the severe snowstorm that struck large portions of the South and East, including UPS’s hub in Louisville, KY and FedEx’s in Memphis, Tenn., for much of the delay.

There’s a limit to how many extra people and equipment can be crammed into the system. The problem, said Hempstead, is that many e-tailers are unrealistic about the ability of carriers to fulfill delivery commitments, especially when a large part of the country is paralyzed by a storm. The big online merchants have access to detailed information about conditions in various regions, and could inform consumers that certain areas will be subject to delays — just as UPS and FedEx make exceptions in cases of bad weather. But competition among sellers is so fierce that no one wants to lose prospective buyers by telling them the truth.

O’Toole demands refunds for N.J. customers whose Christmas packages were delayed – NJ.com

It’s not enough that Amazon has promised customers impacted by late deliveries from United Parcel Service and FedEX $20 gift cards and refunds on shipping charges, said State Sen. Kevin O’Toole (R-Bergen).

This morning the senator sent letters to the New Jersey Division of Consumer Affairs, FedEx and UPS explaining why he thinks each of the carriers should step up to refund shipping charges on packages that were unexpectedly delayed ahead of Christmas.

UPS clears backlog – CNN

UPS on Friday finished delivering its backlog of holiday packages, company spokeswoman Natalie Godwin told CNN.

UPS did not provide numbers, but the spokeswoman said the backlog was cleared Friday.

“Yes, the holiday packages have been delivered,” Godwin said.

A lot of gifts that did not make it to the Christmas tree on time, the question is whose fault was it? Amazon said they processed goods on time. Not everybody thinks the blame should rest with UPS. I just got off the phone with Michael Pack, he said the blame rests with Amazon, that it was their fault for not accurately forecasting demand. He said Amazon is a victim of its own success.
