The courts should not legislate. ever.the conservative position has always been against bypassing the legislative process in favor of judicial activism.  So in this case congress can simply get together and develop a compromise that works for most parties. that is how congress is supposed to work but they have been so busy fighting for personal political gain that they refuse to legislate.</blockquote>
