They will abuse it, and as always, tell you to file a grievance. The problem with grievances is even when you win, you only win what you should have already had. They want VCDs? fine, but whats the penalty when they use them outside of the scope of what they are designed for? Right now the penalty is they have to create a fulltime job immediately. But isnt that what they should have done before they abused it? So we win something we should have already had? thats not a penalty. There needs to be a real penalty. Maybe a significant monetary penalty. I dont know. Something to make them think twice before the disregard the contract like they have been doing for years and years. A guy gets fired and even if he wins backpay, once again, he won what he should have already had. Meanwhile he lost his house while he was out of work for 18 months. Than he gets backpay at straight time, So he actually loses even though he won his arbitration. UPS should have to pay a significant fine to the employee whom they violated if that grievance is sustained. I just think they should have thought it out more before they agreed to use VCDs. Once again, not a terrible idea. But they should have made the company really pay for there abuse when they abuse it, which they will. I also believe they should have tweaked article 18 section 4. An arbitrator ruled when the two stewards were fired for violating the no strike clause that stewards can be held to a higher standard and fired if the strike is deemed illegal. which in there case it was deemed illegal. The arbitrator had said that since the language was never challenged or changed that local 804 must accept how it is interpreted. So why did they not renegotiate that article?</p></blockquote><p></p>
