I think the solution to such situations is not for the gov't or any other 3rd party to become involved but rather to let be ie "Let Do" (french meaning of Laissez Faire) the actual owner of the bathroom (called property rights) to set policy on who and how the bathroom is used and then in this case customers can vote with their dollars on how well they like the policy. I suspect any business who decides to create a bathroom policy where a potential of risk such as being asserted or suggested here would in most areas not economically survive or at best have a very limited clientele that restricts the potential for economic growth and viability of the business.
If both sides continue to push this issue, the bathrooms of small business will become popular among large business owners. What are bathrooms in small business? The single bathroom with single toilet that everyone uses. In large businesses, a single bathroom will create the "line" effect most famously known as an aftermath of state enforced intervention otherwise known popularly as socialism. Contrary to popular myth, socialism has its adherents on both sides of the political isle and this issue IMO demonstrates it.
For the most part, I see this whole issue as one for people (those on either side of this issue) are most prone to emotional hysterics and irrational thinking to begin with so there you go.
