Retroactive checks

Alright so I’m sure the forums have been bombarded with backpay questions but anyway. I was working with ups from Nov18-feb19 but I was terminated to which i and a few union reps had a meeting with some ups bosses who ultimately decided to terminate me. My union gave me the choice to resign saying it would be best for me to resign which not sure if that’s the case as I’ve found out that the union are some sneaky sob’s. So anyway just in case ups tries to get by with not paying me backpay for the hours I worked I’m trying to get together the hours I’ve worked but I can’t log in to UPSers anymore. Any suggestions as to how I can obtain my hours or who to contact to figure this :censored2: out? Thanks

You were terminated which means you forfieted your right to a back pay check and there's nothing the union can do at this point were you hired on as a seasonal employee?

If you resign the company will not usually fight you on unemployment.

According to both attorneys I’ve spoken to that money is required to be payed out to me ‍♂️
You’re gonna hire an attorney for a few months backpay?

It’s pretty simple really. You were never employed while the new contract was in effect. Therefore no backpay.

You worked under the old contract. The new contract was initiated 5/1/2019 and part of that contract was to give a retroactive check to employees who both work for the company and made less than they would have under the new terms.

You were never a part of the new contract.

Sometimes the company can and will find arbritrary ways to not pay you what they owe you. It's just something you gotta grit your teeth over and move on.

My guess is there are likely thousands that fall into this "class action" scenario....

....and if it involves OT hours, it falls within the purview of the Wage and Hour Division of the DOL.

Why are you guys rushing to validate UPS screwing over these people???
Screwing them over? Seems pretty clear to me. They never worked under the contract that gave raises

How is the union sneaky? In certain cases a resignation can be the better option for the member.

Not trying to validate it, it's in the contract. You have to work under the new contract, not just old

The way I see it, anyone who has worked since last August was working in the period of time that is covered by the contract, and are entitled to the provisions of the contract. The fact that the contract did not go into effect until the time it did ought not have any bearing on eligibility for back pay.
