To the best of my knowledge, the courts have ruled fairly consistently that driving on public roads is a not a right, but a privilege granted by the state. It's an important distinction because legally privileges are much easier to take away. Here in Virginia the DMV can revoke your lisence without ever going to court, for instance. Revoking someones right to free speech, on the other hand, faces a much higher legal hurdle.

I'm with leastbest on this one as far as holding the judiciary accountable. The tough laws are already on the books, they just need to be enforced.
