I'm not sure when it was posted or on what platform. Could have been only visible to friends I guess depending on his privacy settings.

The juror will be questioned about this at a hearing during the appeals process. He should face criminal penalties for this crap but we all know that's not gonna happen.

There's privacy settings on facebook.
Photos can be set as visible only to friends, friends of friends, or public to everyone. It may not have even been on his account, could have been on the account of one of the other people in the photo. Who knows.
