I would say no. Definition of passenger is "a traveler on a public or private conveyance other than the driver, pilot, or crew."
I would say yes. Example: You are a passenger on a plane as in a ticketed passenger even in the terminal. So, even sitting on the plane(not moving) you are subject to the FAA rules for PASSENGERS.....

UPS can make any rule they want as long as it doesn't violate the contract.....but then they do....
