Headline is misleading. They were trespassing. Going through a gate uninvited or unwanted was the first clue.

Normally after 9pm I'd agree with you but.. he wakes us up at 530am. So weekends or on vacation we let him stay up till 11pm so that he sleeps till 7-730am.
