Because they do not think it is an issue to offer a defense for at this stage. They think the burden should be on the government to show he has no right to the documents.

However, Trusty complained that the former president shouldn’t have to mount a defense now to criminal charges that have yet to be filed.

How is showing evidence that the documents had indeed been declassified as the Judge requested " mounting a defense'?

nice deflection and non answer. Trump has claimed from the start he declassified the documents...................why wont his lawyers testify under oath that he did just that?
