Local 804 Drivers Walked Out

You have gone to far on your examples!!! Don't compare any of those men and women to this pls! Those men and women followed orders of there duty! These men followed orders BELIEVING they where doing the right thing with no punishment to follow! No valor here!

Come on son!

"No valor here!"? What the Maspeth 250 did took a lot of backbone! They stood up to an employer who has a well deserved reputation for running roughshod over their workers. They grew tired and angry at the constant violations of their contract and the blatant attacks by UPS on their co-workers. Don't try to downplay or cheapen their actions simply because the confrontation they engaged in was a bit more than you would be able to stomach. And don't try to give all the credit to one BA, who, from what I saw in the video, did tell people they could be disciplined, fired or suspended, and that whether they went right back in or stayed out there, they should all do it together. They made a choice to stand up to UPS! Granted, it's apparently not the choice that you would have made, but it's the same choice made by those soldiers in that hostile land, those firemen rushing into the WTC and activists around the country 55 years ago confronting racism.

The Maspeth 250 were "doing the right thing"! I understand that you're not comfortable with that because it wasn't the easy thing to do and it wasn't the safe thing to do. But it was the right thing to do! There will come a time in resolution discussions between the Union and UPS, or through a decision of an Arbitrator, that those 250 Maspeth drivers will be reinstated based on the language in the contract that gave them the right to engage in that protected activity. When that happens, I hope you won't be foolish enough to tell them that there was "No valor here"!

Brown Spider, I know longer work for UPS; terminated years ago. This particular UPS/Union fight is very interesting, I can't imagine why UPS would allow everyone of the 250 drivers to return to work. This would set a major precedence, that would give the green light for work stoppages nationwide at any and all UPS buildings. If they let it fly here, there would be walkouts all over the country anytime someone is fired. I don't remember any language in the contract when I was working that allowed for a temporary work stoppage due to a disagreement over the termination of an employee. The original driver will perhaps return to his position, just can't think of a reason UPS would not make an example of at least a few people. I feel for the drivers and their families, its a tough economy out there and not a great time to be looking for a job. I do remember in my years at UPS and being a shop steward, things are never what they seem. Their local representation that organized that work stoppage should be removed from his position, if people are losing their jobs; let him be first.

I think the key here is your statement that you don't remember any language in the contract when you were working that allowed for a work stoppage due to a disagreement over the termination of an employee. The language in question does not allow a work stoppage due to a disagreement over the termination of an employee. However, a work stoppage can take place when the company does not abide by the procedures prescribed for the settlement of disputes and differences. That's what happened here and the language only applies here. It can be found in Article 18, Section 4 a) of the Teamsters Local 804 Supplement and reads as follows:

The Union agrees that it will not cause or permit its members to cause strikes of any kind, stoppages, or any other interference with any of the operations of the Company during the term of this Agreement, so long as the Company abides by the procedure prescribed for the settlement of disputes and differences and the decisions of the arbitrators.

The company failed to abide as required and the work stoppage took place as allowed.

It sounded like UPS did follow procedure and had a hearing for Reyes before he was terminated. His next step should have been arbitration, not Liam staging a walkout.

I see Liam is getting some love taps from maspeth! Liam!! Stay in the network.

Come on son!

You have a serious issue and you don't even know. This guy is here making jokes, while me and 249 guys are fighting for our jobs back. It's people like you who make the Union weak, by using such a time for your political advantage. Do me a favor and stay far away from the "Maspeth 250".

I'm with you and the other 249, but I think it's unfair to blame politics when the rest of the year the 804 and TDU has no issue blasting the IBT at every turn.

Stink, at this present moment, me and the rest of us in maspeth appreciate hall coming down here. Just check out our local website. I'm just saying, now its not the time for TDU this, and IBT that. Management is loving this division that we have in what was suppose to be a "Brotherhood, A Brotherhood of Teamsters. Right or Wrong Management protects their own. You would think would do that as a UNION. Especially in this situation.
