MDVC Form Changes

I’m not even understanding what the problem is with this new form, or the way they are doing it now. Couldn’t they see your DL record every year when you signed the old form? So this just backdates so they can see further back, but if you were signing the form every year they've already seen all those years already. I just didn’t sign it without checking with a steward first because I usually RTS everything.

Yes but correct me if I’m wrong. When you fill out the yearly MVC doesn’t that give them access to your driving record for the past year? At the end of the day anyone that gets a DWI is a m0ron And if you get a speeding ticket tell them within 24 hours or whatever it is.

I’d say if you got a DWI during a global pandemic you really done effed up....most cops I know around here made zero car stops unless absolutely necessary.

Yes. Once every twelve months is what UPS has been running for years. The following excerpt is from the notice UPS provided us:
"All UPS drivers
Federal Motor Carrier Safety Regulations require UPS to make an annual inquiry into each of your Motor Vehicle Records (MVR) and ensure that you submit a Motor Vehicle Driver Certification (MVDC)" THAT'S what is required by law. UPS even acknowledges this.
What UPS NOW has access to more is much more invasive and not required by law. We just want to submit our MVDC; not agree to all of this other Real Time BS.

Under this new major change; UPS can access your driving records and "other" records in real time. Driver MVR Monitoring - Find out about DUIs/Suspensions & more in real-time Watch the video. What does the "much more" consist of?

It also appears UPS is not in compliance and possibly acting illegally.

  • Disclosure: This notice must be given to the applicant or employee independently of other paperwork. For applicants, for example, you cannot include the disclosure statement on the application. The disclosure must be clear and conspicuous, in writing and consist solely of the disclosure. If you intend to run periodic MVRs on a driver after they’re hired (as part of an MVR Monitoring program, for example), that information must be very clearly stated within the disclosure.
  • Authorization: You must receive authorization from the driver that acknowledges they received the Disclosure. The driver must also give their consent before you can obtain their motor vehicle report.
  • Summary of Rights: The driver must be provided with a copy of the “Summary of Your Rights Under the Fair Credit Reporting Act.”
Additionally, you must certify that you’re running compliant motor vehicle reports with the background check company that is running your searches. Through this process, you must certify you’ve provided the consumer with the disclosure, received authorization and will not misuse the information or discriminate based on the results."

Did anyone receive a separate disclosure form clearly stating that periodic (or even real time) MVRs will be run? This disclosure is required by law.

If you signed that form and stated that you received that "supposed" disclosure; but did not receive it; are you in violation of anything or can it be construed as being dishonest? You did not receive it. It is not posted on the UPSers.com website or the Human Resources pages where you MDVR form is located.

We probably did receive the Summary of Rights Under the FCRA when we hired in.

Definitely overkill. Definitely bordering on intrusion on rights and liberty. I just don’t think it’s a battle worth fighting whatsoever. I think it’s reasonable for the company to expect us to be safe drivers, and in compliance on the road at all times.

So this is how our issues are addressed? It’s no wonder we have pissed off tdu members out there.

Like what do expect a package car driver to do over policy changes at the company? Isn’t that y’all’s job to address?

Talk about this a little bit more, what do you mean?
This is a brief rough summary of how UPS retaliated against these pilots.

A UPS 747 Pilot reported a safety concern to UPS. UPS did not act on it. The pilot reported it to the TSA.
UPS did not like that it was reported to the TSA.
UPS had to retaliate....because that is what UPS does.
UPS combed thru hundreds of pilots records to find compromised pilots who could be easily threatened and manipulated.
UPS found pilots who had not disclosed DUI's and Refusal to submit to chemical tests. Pilots who receive DUI's And / Or Refuse to submit to chemical tests are required by law to be report those violations to the FAA.
UPS then threatened and forced these compromised pilots to write false statements against the pilot who reported the safety issue.
These false statements included creating a hostile workplace, etc.
These false statements were then used to target the pilot. These false statements were then sent the Aviation Medical Examiner (AME).
The pilot of 22 years was terminated based off of these false statements.

UPS has also forced drivers to write false statements against other drivers as well in order to target and terminate these "special performers" "problem drivers" UPS has forced and / or attempted to force UPS employees to write false statements about me.

So, as the new overly intrusive Continuous Motor Vehicle Record Monitoring relates to UPS ground drivers: UPS can now check drivers records hourly, daily, or weekly. Before you only had to disclose driving violations of "which you have been convicted of" yearly. What you have signed for years consisted of: "Include all convictions regardless of whether they occurred while operating a personal or company vehicle...." Now UPS can find out daily of infractions that you may not be convicted of; and therefore not required to report. WHY would you if you had not been convicted?

UPS has employees they want to get rid of for various reasons. Drivers who are too old, too slow, report safety concerns, report harassments, etc.

UPS can now find a driver who got a ticket or who knows what else? Talk to the that driver the next day. Say; hey we know you got that ticket and it seems you may be an unsafe driver or any number of other threats. But UPS then says "hey we can forget about this, or not harshly enforce it....if you DO SOMETHING for us.

A little of topic. But regarding UPS management forcing others to write false statements in order to target other drivers: Hopefully that method of retaliation was not the thing that set off the senseless violence in SF that tragically cost 4 UPSers their lives.

Let's assume a driver wants to write a false statement against another driver: Is there anything that can be done to fight against this? How can a driver protect himself against baseless allegations?

I'm trying to imagine such a scenario, and it's dangerous. Turn-coat "teamsters".
