I thought even on the diad 5 anything past 1030 and 30 seconds was late?

10:30.... is 10:30.

Even the old SPARCS program recorded it accurately.


I've used this argument in 9.5 hearings.

UPS: "He was only 1 minute over 9.5. That shouldn't be a violation."


ME: "Is NDA late @10:31am.... and, with no threats of discipline ?"

I've never gone out of my way to test it lol. Once or twice I've gotten scans off at the location at 1030 and they weren't late.

As the argument, I love it -- nothing the company can say. :lol:

For a while if it wasn't scanned by 10:29 it would show as late but they changed that.
 
The only way it does not count, would be if you agree not to file. If you are paid over 9.5 3 times in 1 week and file, you will win. If you volunteered on one of those days for extra work, extra work will no longer be offered to you.

We had a guy that volunteered to work the preload, then signed up for the 9/5 list because he wanted a shorter day on route. Bosses quit allowing him to work the preload.
Our amazing BA throws out all 9.5 grievances. "They gotta be able to run the business". Doesn't affect him as he shows up for three or four hours a day.

we have always worked under the assumption here that the company agrees to keep one UNDER 9.5 meaning 9.5 is a violation
