But the Dr. Report says I can return to work but on light duty. Ups management said it wasn't available so I've been seeing thevDr. Doing physical therapy till the light duties lifted .
No such thing as light duty at UPS. So you wait till the restriction is lifted and go back. They can’t fire you when you’re on comp. Get a lawyer.

Yes I have management at ups put me on workers comp said no light duty was available. So I've been waiting for the Dr. To lift the light duty to return. It took over a month to get income from Washington mutual when I spoke to adjuster he said it had been fixed a d the information they needed sent.
I think I'm had cause I never received documentation stating my manager put me on Comp.
And my Dr. Reports say able to work light duties .

What did your Dr tell you recently that made UPS think you were coming back to work?

Did he say you can go back on light duty recently, but you just ignored him, and the letter from UPS and decided that since your Sup told you 5 months ago that there was no light duty, that you would not go back to work now?

It doesn’t sound like this letter and discharge is related to last December.

You’re going to need a lawyer. But start with your BA.

Not true. It’s called TAW. Temporary Alternate Work and it is covered in the contract.

Article 14 Section 2 of the Master
Workman’s comp isn’t TAW. I was on comp for over a year after a surgery TAW is only 30 days isn’t it? I don’t believe they can terminate you while you’re on comp. I’ll defer to you if I’m wrong

Then on March 8th I got a letter that said I did not return to work 72 hrs. Prior therfore I was terminated . I called liberty mutual he said he sent an email it was fixed something about wrong code may have been put in. I tried texting management no reply. Dr still has light duty but I saw specialist and no surgery is needed so light duty will be off and now I have no job.

Waiting on the union I filed a greavance but it might be to late.

TAW is only 30 days isn’t it?

That depends. Here, it is only 14. In other areas, the 30 days come in because if a job is in for 30 days, it becomes a permanent job and gets bid.

Nope. In this case, he seems to have a 3 day no call no show, or a 72 hour termination. Sounds like the left hand doesn’t know what the right hand is doing.

Probably sent from the center manager, not having any paperwork showing him on Comp.

I doubt it’s too late. Even if your grievance was untimely, UPS cannot fire you while on Comp.

And once you go on Comp, not TAW, you don’t come back until you are released to full duty.

It sounds like your Comp was legit and approved.

If they wanted to terminate you for the original light duty request from last year, they’re too late. They only have 10 days. So don’t worry if the Sup doesn’t remember telling you there was no light duty at the time.

Sounds like your center manager didn’t know, or have proof, that your leave was approved.

The Union should have no problem vacating your discharge, if I understand the facts correctly.

I would still talk to the lawyer unless the Union “fixes” this before you talk to him.

This is a little coincidental, because it happened to me.

I received a 3 day no call no show termination letter from my center manager at my house while I was off on Worker’s Comp.

A good workers comp lawyer will gladly accept your case. Im sure there are details missing here, but it sounds like a bunch of BS. If you care about your job, your health and well-being, be pro-active and get a lawyer ASAP. Even if you're "fired", you will get your job back and any money owed...eventually.

We also have a PACE program here for RPCDs and feeder employees who have been lost time comp cases. It's not "light" duty, but more of a gradual return to full work that is overseen by a licensed physical therapist. Liberty Mutual, Risk Management, your supervisor group and the union must all agree it's a viable path to recovery and full service.
