Quadruple time 9.5 penalty isn’t enough to deter the company. How much would it take?

Only the middle of February and have dozens of people where I am getting ready to hit quadruple time or already hit it for going over 9.5 and no end in sight. And they don’t care. No intention of hiring anyone.

Maybe we should ask for 10x ?

Every contract time that came around I always proposed that any time there was a 9.5 violation for a certain week then that person should be paid triple time for ALL hours worked for that week. The payment would be automatic after the 3rd 9.5. I'm not even sure that would deter it but that was my proposal. Of course it was laughed at; and that's with one of my best friends now being one of the top negotiators at the table for the union side

Yep, we were told quadruple time would put an end all this. But clearly it’s not enough of a penalty the bean counter somewhere figure it’s worth it instead of hiring another driver over the long-term.

Yes some of them receiving $500-$800 extra week. So far.
Crazy. Has your local pursued to committee meetings that the contract allows at higher levels? Or has the company just agreed to pay the quadruple time? The new language does allow for pushing the envelope further, but it would take a move by local leaders to push it

The company agreed to pay before the committee was even involved, but they are involved as well. Like I said we’re only in February. There’s no way it’s going to be “managed” this year. Unless they hire people and they have no intention. This does not appear to be a nationwide problem, but certainly a problem in many places, and it doesn’t appear quadruple time is enough to deter the company. It’s cheaper to pay it.

Well that sucks. Which local are you in? I'm wondering if the chairs of the committee know how widespread it is or isn't. Next time I talk to my friend I'll ask him about it

Lol they definitely know. The process is working about as well as it can. I don’t blame them. The companies response is, “volume is supposed to go down most likely this summer”. Thats when the Amazon volume starts to go away. I don’t see it happening, we will be slammed with vacations as well at that time.

I certainly like the idea of automatic triple time payment after you’re on the 9.5 list I think the company would be a lot quicker to react if the penalty was immediate instead of filing for it. Maybe after the fourth one you could file for quadruple time. But really going throughthe grievance procedure to receive the penalty is a little more time consuming and the company isn't really concerned very quickly.

I put it out there in writing every contract time. I knew it would never get in. The only way any language will work is if the company couldn't afford not to follow it. In all honesty though, it's never been a top priority in negotiations, although this last contract it did get more attention paid to it. Of course I was retired for that one lol

If the cost of the grievances somehow matched what it would cost to hire another driver it might change their mind. They're technically saving money and once Summer seasonal hits (another scam) they won't have to hire drivers the rest of the year. Rinse and repeat.

Simple: Increase hours limit paid to pension.
