Yes, this is the OSHA mandate suit. The mandate was originally injoined by the 5th circuit, then they bundled all the suits against this particular mandate together and did a lottery to see which circuit would hear the case. The 6th Circuit court of appeals got it. Some judges wanted it to go straight to the en banc hearing, because it had to be heard en banc anyway. But they decided to have the three judge panel rule first. The en banc hearing will see the mandate shot down, as an actual decision, not just and injoinment. Then Biden will have to appeal to SCOTUS to try to get it reinstated. Pretty good chance SCOTUS will also shoot down the mandate.

Shapiro talked about it when the mandate was first announced in September. Haven't heard from talk about it since. Probably playing his cards close to his chest since the Daily Wire is suing the administration over the rule.
