Local 804 Drivers Walked Out

I have been watching this forum for the last few weeks since the action in Maspeth, lurking, if you will. I am a retired driver and former steward in that building. To sit here and read the sniping and backbiting coming from, what it seems like folks who have way too much time on their hands and far to many uneducated opinions is truly sad. I know personally some of the guys who were walked off the job on Monday and I was Jairo's steward. He is and was always a stand up guy and worked his tail off for UPS. I retired in 2007 and know for a fact that he was changing his start time, approved by the suits since I was there. His route is unique and demands that he be ready to leave the building ASAP. As far as all the talk of contract knowledge and views of right or wrong this will be played out in the office of the arbitrator not here in Brown Café. As they say, opinions are like :censored2:s....we all have one. But please, spare me the pseudo-intellectual personal attacks of the likes of some of you who not only sound like someone I wouldn't want standing shoulder to shoulder with me in an organized labor situation but wouldn't want to even be in the same room with you personally. For someone who should be feeling, if nothing less, a kindred spirit with fellow workers it is appalling to read other drivers proclaiming the righteousness of this evil heavy handed company in the discharge of these guys. Where a 2 or 3 day suspension would have served the same purpose (which, by the way, is what Ron Carey took in the 80's for the very same action). I'm a pragmatic guy and never thought for a minute that I had 100% of my people behind me or any of my decisions but for god's sake, stop mocking them and stop supporting people who are set against your own best interest.
Thank you brother for the best post yet on this subject.

The original driver was fired and walked out for allegedly changing his own start time. Even if this is true this is not stealing time. He was working. According to Reyes himself, he told his manager about a less senior driver starting before him and his manager said to start up early. It seems now the manager is denying that occurred. So they once again disregard our contract and walk this very senior driver (26 yrs), a former military man himself, for a non cardinal sin.
According to our supplement, strikes are illegal "so long as the Company abides by the procedure prescribed for the settlement of disputes and differences and the decisions of the arbitrators as provided in this agreement."
The way I see it, UPS did not abide by that procedure. Of course, it most cases UPS gets away with it. But Liam seemed to want to make a stand on this. He knew that Dave had jumped the gun a bit in Melville. But Liam waited for them to actually walk him out on that bogus charge and he made his move. An arbitrator will see this and re-instate reyes as well as the 248 other drivers.

You're assuming he was working.
You're assuming the Ctr. Mgr. said those things.
You're assuming the Ctr. Mgr. is denying those things.
You're assuming, well a whole lot of things...

I also see the union (in the form of employees/stewards) "disregard the contract" on a regular basis when it suits them. It goes both ways.

I personally don't believe members should there jobs due to irresponsible actions of our leadership. What are penalty in this nothing!! The union meeting will be a MMA fight if we keep losing members.

Will reformers be a group to give up our right to strike in 804.

More drivers fired last night. Do not have exact number, 15+ I believe though. I'm sure we will hear more about this.

FYI EVERYONE Timmy is MIA in Chicago at the TDU Labor Notes Conference. I can't believe he actually left the state with everything going on. Like we need more TDU nonsense here.

Open your eyes people! Tim is preparing for a run against Hoffa or Hall. These drivers are being used here to slander the international for not stepping in! I'm sure the international would put us in trusteeship but! This would give TDU locals legs to stand on!

Tim makes it sound like we are on top of the world.I will agree they negotiated a good supplement.I just hope his apparent over confidence holds water getting these jobs back lost by his incompetent business agent. A business agent that myself and every other employee at 804 I speak to agree should have been fired that day on the spot. His actions are inexcusable and might be extremely detrimental to our locals future.

A GOOD SUPPLEMENT? Lmfao!..
If local804 supplement were in place all of my brothers and sisters in maspeth would have been fired the very next day of the walkout! Why?
Simply 3 words, vacation cover drivers!...

Nice job local804 Eboard! Of course I'm being facetious!

Actually no. They can only use VCDs between Memorial Day and Labor Day.

804brown, 26 more drivers lost their jobs yesterday! What's Tim doing about it?
By the way the company didn't have to hire anybody after firing 50 drivers they just did that base on the fact that attendance is 100%.
Where is TDU with solutions.

TDU is in Chicago doing more "important" things?

Actually Labor Notes is having their annual convention, not TDU. They are separate entities.
Hopefully Tim is in Chicago ramping up the support from other national unions as well as staying in contact with UPS on what is going on back home. Im sure he is capable enough to be able to do two things at once.

Why don't you respond to the point 804 Brown made about your previous post bigd? You seem to think that VCDs could have been used to replace all of the Maspeth drivers if the Supplement were in place. Might wanna' walk that back, bigd.

Lets see. He and his E/B fixed our Health Funds, added more BAs especially to the night and early morning shifts and delivered on a supplement that bumped our pensions to $4k/month, fixed the grievance procedure, fixed the 8hr clerk problem and added at least 150 new FT jobs.Plus my BA is in my building 2 to 3 times a week. Not bad for a bunch of newbie reformers in their first 3 years.
