Because Trump is no longer president and it's his second impeachment trial in the Senate the CJ can refuse to sit on the second trial which Roberts did do The job then falls to the President Pro Tempore of the Senate.
Is that in the Constitution? Or did Roberts just refuse to be part of it?

56-44 in favor of going forward. The constitutionality of it would be up to a court to decide.

The Constitution provides that the President “shall be removed from office on impeachment for, and conviction of, treason, bribery, or other high crimes and misdemeanors,” but it says nothing about the timing of when the impeachment and trial may take place.

He was impeached while he was in office. Robert’s has to sit for a trial of the President. The President is Joe Biden now. This all a plain text reading of the constitution, something conservatives claim to love.

It makes no sense for presidents who commit misconduct late in their terms, or perhaps not discovered until late in their terms, to be immune from what the Constitution allows ; barring them from serving in any other federal office or from receiving any federal pensions.

He's about to be acquitted because enough senators believe the trial is unconstitutional. The opinion of one of Freddy's overseers is irrelevant.

Do you ever get tired of being wrong about everything?
The penalties for impeachment are designed to protect the republic from the very type of people who have abused their office in such a manner that they should never be entrusted with public power again. It makes no sense for former officials, or ones who step down just in time, to escape justice.
