I don't know where your from... But that sounds like an excuse for them. I'd ask for proof in the contract, which I bet you/they won't find.

Your a cover driver / swing driver what ever you want to call it. In some areas of the country cover driver bid there routes weekly by seniority in other parts like mine your are put where you are needed you don't get a choice seniority doesn't apply except to allow you to work or not depending..
