Right now in my area the company is working sups on Saturdays claiming they are exhausting all options and they need to work because they can't get enough volunteers.

My local has told them that's BS. They have the ability to hire as many seasonals as they need for peak. If they under staffed that's their fault and not exhausting all options.

Company just doesn't want to hire and as always expects the union to take the short end of the stick to help then out.

Exactly. Same here. The moment that contract was ratified they should have been off to the races. Change week to 70 hour rule. Company doesn’t want to pay double. Three weeks of double is not going to sink the ship! Advancing all this volume to beat competition on on time peak percentage etc for sales leverage next year!

And what assumptions am I making?

I know for a fact he is about to retire. I know what his pension is. He has said that he wants the company to pay for the way he was treated. Should I quote some posts of his?

There were options a month ago. The only option besides forcing drivers in now is throwing cash at volunteers. So the way I see it, there are two options, not "many."

If they want to throw cash at volunteers, fine. I never said I didn't like that.

It’s not like officially endorsing UPS breaking the contract sets a horrible precedent, or anything.

Never said that. The contract allowed for a 60 day transition period. The Union only wants to extend that 60 days. That is not uncommon. Read some contract law. It happens all the time. An extension of a negotiated clause in a contract.

As a matter of fact, it is already in the contract.

This clause gives the Company and Union leeway to try and resolve the issue after the 60 day period. Which is where we are at now.

Article 11

(v) In any buildings without sufficient staffing to handle Saturday delivery needs after the process set forth above, the Local Union and the Company will meet and resolve on a local basis. If not resolved within sixty (60) days of ratification, the matter may be referred to the Co-Chairs of the National Negotiating Committee or their designees for resolution

Guess again. Do you know how many area that they cannot get any more workers, or rental trucks?

Locally, we needed over 300 between helpers and part time. They would have hired the full 300 to staff the operation. After most quit on the first day, we only have 162 out of the 300 needed. Sorry, but they tried.

Everything was gone long ago and nobody wants to work nowadays.

We were shipping in rentals from other states. Nothing left locally. And we are still short rentals.

I won’t work 70 and not everybody would, it’s a tool that can used if drivers run out of hours and most drivers would gladly do it to get two days off. And that would be your answer to no force. That language is actually allowed in the contract.

I am forced to work on excess of 60 hours today. Only difference is my hours over 60 are being paid at time and a half because the 70 hour rule is not in effect. If I'm gonna be here then yes being paid double time would be preferable to being paid time and a half

The problem is not working 70 hours during the week as opposed to 60 hours. Do you want to be out until 10:00 PM?

I got news for you. UPS doesn't want you out until 10 at night.

The problem is Saturday delivery, not 70 hours in 5 days.

DOT does not allow you to drive after being on the clock for 60 hours in a week. How are you being forced to work over 60 hours?

I see, you want them to lose money....Sorry, not how business works. They offered the negotiated rate in the contract and didn't have enough interested in the job.

Sups can now work all they want. But you're OK with that as long as you don't work Saturday. But then again, you'll probably file on Sups working.

Wrong. A lot of this volume run on Saturday is advanced Monday volume. Stop advancing the volume. I don’t care what UPS wants if it gets done. I care that a LEGAL contract that they agreed to is followed! I’ve told you this already! You talk about loosing customers. Let me tell you something they have been trying to advance all this volume all week. Half of my packages looked like $&$& because of all this trying to shove it down are throats. It’s embarrassing. That will loose customers!

Okay I’ll bite. You said that they couldn’t get trucks and workers etc.. but you have also said it will dealt with next year and it it won’t happen again. What are they going to do when they can’t get enough seasonal to meet their driver/seasonals/trucks ratio next year?? You going to change your tune?? Or is it back to we got to do it to keep the customers?!?!

Relax! Then why I’m I at home not being forced with the same circumstances that all these other locals that are forced right now. Trust me I’m in the biggest center in state and my local said no. Not enough volunteers, trucks, etc. Dude you’re wrong this is about local leadership period. Stop making excuses!
