The company wants to trade the stealing time grievance for your overtime grievances. If this happens make sure you are paid for this time off/back pay. If they push it to Seattle it's definitely back pay. They want you to give up two big amounts of pay for an accusation that's weak.

Seven grievances?

I have filed the grand total of one in 28 years.

You can expect part of your return to work agreement to be the retraction of all 7 of those grievances.

And you wonder why they were following you?

Highly doubt it. But one in 28 years? Wow. You either work at the best Center in the USA (in which case every driver at my Center is jealous) or are just fine with getting bullied. But if the latter, the way I was brought up, if you are getting bullied, you don't just stand there and let them repeatedly punch you in the face unprovoked, you knock them out.

The grievance was over a vacation check payroll error and was corrected in a timely manner.

All of the other issues were resolved without the need to put pen to paper.

Exactly. That's actually what my union rep is thinks they're thinking.

Sounds like really nice Center then. It's the opposite at my Center. The new Center Manager started way down on preload, then moved up to preload sup etc. etc.

Many of the most senior drivers have know him since they were all just youngins working preload together and used to all be close and really great friends. But now none of the driver's can stand him and do not talk to him anymore because it's this kind of assault on the drivers all the time. They all say I just drew the short straw this year because I'm newer and they do not like me standing my ground.

I do think that they will offer this to me but we'll see what happens. Center Level hearing is next after grievances are all filed and then if nothing resolves there it goes to the panel in Seattle.

The stickler here to me is still that they decided to begin following me around less than 24 hours after I filed a total of seven grievances. Clear harassment and retaliation. So if they want to offer no back pay fine, I don't care. It's only been 4 days and I've already completed four semi-major house renovation projects I needed to get done before winter and couldn't before because of the repeated 14-hour days.

Take the job back when offered. Keep your mouth shut your head down and do what told for the next 5/6 months.

Not young in fact. And definitely old enough to know when I'm being maliciously attacked over unfounded claims. A leech has more backbone than anyone in management at my Center. Used to be in journalism, an investigation I did in Arizona led to the mayor of Phoenix promptly resigning after we proved he was trying to break up the local city bus driver's union and give the transportation contracts to his mistresses employer.

I don't if that's the way I'll be treated. But it's fine until an IT position becomes available within or somewhere else. Or something else better suited for my degrees. Hard to say. No one should have to endure such treatment though. No one. What happened to a world of work where everyone respected each other like when my grandfather was in the prime of his working days? Sad if you ask me.
The sad reality is this is called working at ups. Some people aren't cut out for it. You sound like you may be one of those people.


At the very least you need to learn to play the game much better.

Huge wall of text but I think I know what is going on here.

Technically they are correct in that if you stop at a place of business open to the public for the sole purpose of using the restroom that you need to do so either while on one of your paid breaks or during your unpaid lunch break.

Technically the termination appears to be justified.

Is it retaliation? Absolutely.

You put a huge target on your back and they hit the bulls eye.

You DO NOT have to clock out or use meal/break time to use the restroom. It's against the law, PERIOD.

Been straight as an arrow my entire life. Thought this site was a place where UPSers get together and back up one another. Starting to see it for what it really is for the most part, and that's a place where even people who are supposed to be on the same team can instead bash each other and insult each other instead of sticking together and encouraging one another.

If I straighten out my act in any way, shape or form, it will be deleting my Brown Cafe account.

But thanks to all those who understand as does every single driver at my Center has been. I've received calls from literally almost every single driver at my Center telling me everyone's pissed they're doing this and that it's complete BS.

This is my last post, on any topic. Thanks and god bless.

Because most of the time the employee in question is not being nitpicked.

Technically if you stop at Taco Bell just to take a leak you are supposed to either be on a paid break or unpaid meal break. If you make a delivery there and stop to take a leak you can do so on the clock.

Nope. The only way they can legally get you is if you spend money while on the clock. Again, it is against the law, not the contract, but the law to be required to clock out to use the restroom. UPS is in lawsuit territory here. Not that they're smart enough to care, but there, they are.
