I agree. I have a hard time believing that the spirit of the language was to knowingly have a staffing issue and ignore it and just let the drivers violate 9.5 and pay the grievances indefinitely. But here we are.
Is it the drivers who violate 9.5, or is it the Company who is violating? 🤔

My point is that it is the Company who is violating, hence the grievance.

If it was the driver who violated, they would be disciplined.
For sure, and if we willfully violated the contract we would eventually be shown the door.I Don’t get too hung up on someone having an occasional 9.5 issue. But people working 55 and 60 hours every week because the company knows they have a staffing issue and refuses to hire seems blatant to me.

The company just looks at violating the contract as a cost of doing business. Cheaper for them to pay grievances than hire more people.

Yep, and I try to explain that to drivers But they were under the impression 9.5 language was supposed to stop this practice.
Most believe this. Until the contract reads in a way that makes it more expensive to pay out instead of getting drivers in under 9.5 it will continue as is.

I'm still confused on if maybe our center just lost anybody with a brain and killed it's golden goose because our stop counts keep going lower than they ever were in a decade but they still can't keep people under 9.5
