Flynn is still being prosecuted for even after the DOJ moved to dismiss the charges. It's taken Sullivan over 5 months to make the only ruling he can make in the case now. Wonder why he's dragging his feet.

He is being prosecuted for lying to investigators looking into his talking to foreign governments, based on the Logan Act, which doesn't apply to him, and has never successfully been prosecuted. So the investigation was a fraud to begin with, designed to catch him in a lie, which is known as entrapment.
The lie was immaterial to the case, making it a non-criminal act, which was fraudulent to begin with. Then they coerced him into pleading guilty by threatening to prosecute his son for more made up charges. Flynn has gone bankrupt defending himself, with no way to recoup his losses, even for fraudulent prosecution, no wonder he was willing to plead guilty to protect his son.
Icing on the cake, Flynn's lawyer at the time was in on the whole thing. Cherry on top, Biden was one of the people who pushed the idea of charging Flynn based on the Logan Act. This is the sort of corruption we have to look forward to.

the FBI agents who interviewed Flynn said they didn't think he lied. The 302 was later altered to make it appear as if he had lied. FBI used that to coerce a guilty plea, While they were hiding tons of exculpatory evidence.

Yeah, they investigated for a long time and had to manufacture a charge. Flynn is squeaky clean. Flynn's new lawyer has had to ask Trump not to pardon Flynn. The fact that it's taken Sullivan 6 months and still hasn't ruled to dismiss the case demonstrates what sort of slime balls democrat appointed judges are.
