He has language in his contract that covers it on page 283. He would not lose his position in preload. When he isn't driving he would go back to his normal job. He also has language that states he will be given 8 hours when he is scheduled to drive.

I must not be understanding your point. You said he'd lose the security of his preload hours. How would he lose the security of them? When he isn't scheduled he would work preload unless they asked him to drive last minute. If he's scheduled to drive they are required to give him 8 hours. When he isn't scheduled he'd be back in preload.
