What are the chances my husband will have his termination overturned?

I saw a 16 year driver get fired for holding back COD money over the weekend so he could gamble with it. Many addictions out there, and we ain’t exactly choir boys.
We had a driver that was being groomed for management fired for using the COD money as a "loan" .She would pay it back a few days later ,everyone thinks they are smarter than the system

Sorry, but I don’t care anymore.
The stupidest firing I ever saw, a driver was on preload due to a DUI. His mortgage payment is due, so he sends the check UPS overnight. The problem starts when the letter is undeliverable due to an address issue. Turns out when the letter is returned to UPS that it was never paid for. The driver got fired for not paying 10 bucks (at the time) to send it. He just grabbed a label.
Over 10 years of service down the drain for 10 dollars.
Can’t make it up.

I know a feeder driver that sent a pkg to his daughter at a university 2 hours away.
He simply put it on the belt.

He got caught and was told not to do it again.
He did it again and got fired.

I can't imagine being that stupid.

Common sense helping.

It is unbelievable. Seen them fired for not collecting a COD from a customer because the guy didn’t have cash. Again, a driver with nearly 15 years. No way man, no tickee no laundry.

That’s Craptacular
And the supervisors at his center don't want him gone but they had to go through the motions. It's on the higher ups that don't personally know him that will ultimately make the decision.
They don’t need to personally know him to know that he put alcohol ahead of his job. If he knew he couldn’t test dirty or risk termination....why was he drinking at all?

Yep. Why was he drinking at all?
Addiction ..alcohol /drugs is something that people think they know all about.
Unless you are or have had a family member affected, you probably don't.

Anything he did was off clock. I understand what you and everyone else is saying. I get it. But my question is not what they should do, but rather what they can do. Can they deviate from the handbook and give someone their job back, no matter what the termination was for.
Why should there be different rules for people who don’t wanna follow the ones that exist?

WATMA has a full time preload.
Many a driver was cut a break and allowed to go from driving to inside.
If they screwed up inside then they were escorted out.

I am truly sorry this happened to your family, my understanding is that tests happen a year from the incident. If an extended period for testing was agreed to then it will go longer. The company is flexible on a lot of things, more flexible then they need to be, but drug and alcohol use is something that they can’t be. We have had people lose their license and still keep a job at ups, but during that those years they worked trash jobs at the company, they stayed clean.

I'll give you credit.... at least you read the contract before posting.

Article 35 is pretty clear.

Yep.

It will strictly be fought on the basis of he made a mistake.

So my question is, will they make an exception because it's been 18 months of testing and has had no issues until now?

Nope.

The first thing that will raise red flags, is that the SAP felt he needed more than the standard 1-year aftercare

testing/treatment. That gets into the territory of being a chronic alcoholic. He couldn't even make that.

Case and point:

He dropped a dirty for the first time end of March 2022. Termination letter came this past Wednesday as we knew it would.

Good luck.

I’ve only had one person go through SAP more than one time and that went all the way to A panel and it was because a manager made a mistake. The deal was made in a hallway before we went into the panel. I being a smart ass said I thought the company said no one could go through SAP more than once? The labor manager looked at me and said we can do whatever the hell we want. He stormed off, the person went through SAP again he did not make it that time either.

I've read all of your replies. Thank you to those of you that took the time out of your day to answer my questions with seriousness. I feel like I am living in a real life nightmare. I'm beyond pissed at my husband. I can't even look at a UPS truck without my stomach instantly turning, and after the panel the same will probably go for my husband as well. I'm so embarrassed and disgusted by this whole thing I just want to hide from everyone. Such a damn waste. Although we probably already know the answer, I'll be sure to come back here and let you all know what happened. Thank you again.
