We are obligated to follow the contract just like UPS. The contract spells it out and UPS failed to follow through on their duty, obligation, and reponsibilities to staff with in the alotted time.
The only thing that MOE from SOB should read is, "it is or understanding that UPS failed to staff properly in the alotted time. Looks like peak will be difficult for that management team, as there is no 6th punch for RPCD. Happy Holidays!"
I have doubts how much responsibility the IBT really has for this situation vs. the local just making them scapegoats.
To play devil's advocate, I think with the way the original MOU and the wording in article 11 combine make the process a little less black and white than that. If there is no agreement between the local and the company within 60 days of ratification of the contract "the matter may be referred to the Co-Chairs of the National Negotiating Committee or their designees for resolution." ... "and any forced 6th punches will end immediately
upon resolution."
I have heard no rumor of an additional MOU like
@some1else is talking about. Sounds far fetched to me. Putting something like that thru would be a great way to lose a lot of right to work members.
I have heard from a source, who Obama will not let me name, that SOB said to expect a "resolution" by end of this week. I'm not holding my breath.
