Pretty sure that's not even feasible. Trying him as a US citizen is probably the simplest and easiest way to go, if you try and get too cute with your legal strategy you risk getting getting the case thrown out or overturned on appeal.

Why can't the video of one of the Tsarnaev brothers placing the backpack prior to explosion be shown to the public?
Are there pics or video of both brothers leaving the area minus the backpacks?
Either of these would seem to be the final nails in their coffins so to speak.

I'm not sure there is a legal mechanism for stripping the 'alleged' bomber of his US citizenship with or without concrete evidence of an international connection.
Having said that, we've had much better luck trying these cases in the US courts than we've had in military courts.
Either way, this kid's uffcked.

I keep thinking that the Boston bombers were not too bright...
If they'd had the stones to be suicide-bombers, they could have gotten onto the Red Line (subway) after the marathon was over and killed scores of people.
Maybe they thought they'd get away with it, so they could keep bombing later on?
They didn't even try to run until their photos were plastered all over the media.
Really dumb.
