Why not? Should you just wait and then if you don't like the decision call them "activist justices" and impune their character? Besides, I don't think the Justices even pay that much attention to outside criticism.

I just kind of put things on a smaller level and put myself in the picture. If I was appearing in front of a judge for say, traffic tickets. I wouldn't be saying, Listen Judge, you aren't even going to consider half of those tickets because the cop's crazy. So, the highest level of punishment is not applicable to me." Yeah, I could see that happening. NOT. I'd be "yes sir, no sir...."

Things are given to SCOTUS to review and decide......they make the decisions!
