>10 year employee. 1 infraction years ago. New infraction based off of hearsay by a business stop employee. Infraction cussing excessively. Termination letter shows term d/t “unprofessionalism and harassment”. Denies allegations-may have used swear words while in the back of the truck occasionally but no one ever complained to the employee or gave a warning to stop this until threat of termination was made. Employee states was not swearing AT anyone. According to the union steward because of this employee’s work ethic, willingness and ability to drive many different routes manager doesn’t want the termination. Union steward assisting in grievance process.
In your experience how likely is it that this employee will be terminated based off of a pretty clean work history, the seemingly minor infraction, lack of evidence that this was on ongoing issue, and no warnings being given.
The employee loves this job and planned on working here until retirement. Shame this employee didn’t receive even a warning/counseling first with management jumping right to termination. Doesn’t sound like the disciplinary process was followed.

The manager had no leg to stand on for a termination to begin with. At Best it was a warning letter if indeed it was the only infraction the employee ever had termination would’ve never stood up at a panel.. unless of course there’s more to the story. Which is usually the case.

Show remorse and they will get their job back. It’s a game to be played. Do you think the employee cursing like that should be a normalized behavior?

It sounds like someone on the dock heard him and the word got passed on to one of the office bosses who blew it out of proportion. I agree you do need to watch your behavior in public because someone is always watching.

Based on your story I would say little to no chance this person misses any time. If the manager is stupid enough to actually terminate this employee without first giving them the opportunity to improve the employee will be receiving back pay.

Stupid as stupid can be if one cannot filter the potty mouth around others. Nervermind unprofessional conduct, such language might be considered sexual harrarsment. How would that play out in front of a panel?

I'm sure there are security cameras in this business that recorded the interaction and if OPs husband isn't being honest the truth will come out during the investigation.
