How about rights that exist regardless of imaginary lines in the sand.


But what if the court was suggesting that rights exist beyond the Constitution? Even Before the Constitution?
Like "inalienable rights" bestowed by a "Creator"? That would prove inconvenient for the political structure.

And that is dangerous. The courts should be following actual language in federal and state constitutions. Not their feelings on extra contractual ideology.
